What is an E-2 Visa?
The E-2 U.S. Investor Visa is designed for individuals with an entrepreneurial outlook who wish to live and work in the United States while managing their investment. Often called the “Temporary Green Card”, it allows foreign investors from E-2 treaty countries to develop and direct a U.S. business in which they have made a substantial investment. There is no limit to the number of visa renewals, provided the qualifying investment remains active and all conditions are met. This visa is suitable for those purchasing an existing business, starting a new enterprise, or serving as an executive, manager, or essential employee of the investing company.
Visa Requirements
To qualify for an E-2 Visa, you must:
- Be a national of an E-2 treaty country, and if applying as an employee, be from the same country as the company’s major shareholders.
- Have made, or be actively in the process of making, a substantial investment in a real and operating U.S. business.
- Own at least 50% of the enterprise or have operational control through a managerial or executive position.
- Actively direct and manage the business (passive or “silent” investors do not qualify).
- Demonstrate that the business will generate more than a marginal income.
- Intend to depart the U.S. when your visa status ends.
